However, they hope that by leaning on you hard and using various tactics of intimidation, they can scare you into diverting any funds you do happen to have into their pockets.

Tactics commonly used by debt collectors include calling your home every day to annoy you into submission, as well as calling your employer in order to shame you into paying. When these tactics don’t work, debt collectors often turn to threats of legal action, such as suing you, having you arrested, garnishing your wages, seizing your assets, or placing a lien on your home. In most cases, these are just empty threats intended to frighten and intimidate you.

-Statute of limitations. Always investigate the statute of limitations in your state BEFORE you even think about paying on your debt. Some debt collection companies have been known to try to collect on expired debts. This is illegal! If the statute of limitations on your debt has expired, you are no longer responsible for that debt.

-Fair Credit Reporting Act. Debt collection companies are responsible for reporting only ACCURATE information about you to third parties. If they make a “mistake” when reporting your debt to the credit bureaus, it will be easy to get the resulting collection item wiped from your record.

-Fair Debt Collections Act. This is a really important part of your rights as a consumer. Remember all those legal threats your debt collector made? Well, it’s actually illegal for a debt collector to make such threats unless a) they actually intend to take you to court, and b) they could actually win the case against you and get permission carry out their threats. In most cases, suing you is simply not worth the trouble, and the debt collector never really intended to do so. In other cases, (such as an expired debt) there is no legal basis for suing you in the first place.
